Preamble
These terms of sale govern the relationship between:
SPIRUMANNE SARL, a société à responsabilité limitée with capital of €10,000.00, whose registered office is at 57 avenue d’Ax-les-Thermes, 11340 Belcaire, registered under SIREN 881 205 157 at the RCS de Carcassonne, intracommunity VAT number FR84881205157, telephone +33 (0)6 13 12 29 18, email info@spirumanne.com — hereinafter “the Seller” or “Spirumanne” —
and any person wishing to place an order on the site — hereinafter “the Customer”.
The Customer declares that they have read these terms and accept them before confirming their order, by means of an explicit tick box. All information is presented to them in French.
- Version — 1.0 (to validate)
- Effective date — 25 October 2026 (to validate)
Article 1 — Application of the terms
These terms of sale may be amended at any time by Spirumanne. The version applicable to an order is the one in force and accepted on the day of that order; subsequent amendments apply only to later orders.
Special conditions for certain products or services may supplement these general terms; they are then specified when the item is presented.
The fact that any Customer places an order with Spirumanne implies unreserved acceptance of these general terms. If a condition were to be missing, it would be considered governed by the practices in force in the sales sector.
Article 2 — Products
The products offered are those appearing on the site on the day of consultation, subject to available stock.
The information given in catalogues, price lists and site pages is indicative and may be changed without notice. Photographs and illustrations are non-contractual: as these are artisanal products made in small batches, colour, texture and appearance may vary slightly from one batch to another.
Each product page states the name, the list of ingredients, the allergens present, the net weight, the storage conditions and, where applicable, the recommended maximum daily dose, in accordance with Regulation (EU) No 1169/2011. The Customer is invited to read the full list of ingredients before ordering, particularly in the event of an allergy or intolerance.
The products are foodstuffs and culinary preparations. They do not replace a varied and balanced diet or a healthy lifestyle, and in no circumstances constitute treatment or medical advice.
Article 3 — Validity period of offers
The products are offered for sale while stocks last.
If a product that has become unavailable is ordered, the Customer is informed as soon as possible by email or telephone. They are then offered, at their choice, to wait for restocking, to receive an equivalent product instead, or to be refunded the corresponding sum.
Article 4 — Prices and postage
The prices shown on the site are expressed in euros, including all taxes (TTC), packaging included, ex-warehouse, excluding postage. They may be changed at any time and without notice; the applicable prices are those in force at the time of the order, subject to available stock and to any obvious typographical error.
A flat-rate postage charge is added to this price, depending on the delivery method, the weight of the parcel and the destination country. This charge is specified before the order is confirmed and repeated in the summary preceding payment, in accordance with Articles L.112-1 and L.221-5 of the Code de la consommation (French Consumer Code).
Some lines are offered in several formats, with tiered prices: the price per kilo of each format is shown on the product page.
- Free postage — Delivery costs are free from €120.00 of purchases in mainland France, for the methods shown in the summary, subject to confirmation.
- Destinations outside mainland France — [[TO COMPLETE: rates and conditions for Corsica, the overseas territories, the European Union and third countries]]. Any other destination is considered case by case; prices are then understood net, including all taxes, with packaging, transport and insurance costs not included.
The price is payable in full on the day of the order.
Article 5 — Orders
To place an order, the Customer identifies themselves by completing a form containing the information needed for their identification and delivery: surname, first name, telephone number, postal and email address, billing and delivery addresses. Further information may be requested to ensure the quality and safety of the delivery.
The ordering process comprises the following steps: selecting products, displaying the basket, entering contact details, choosing the delivery method and payment method, displaying the detailed summary (products, quantities, prices incl. VAT, postage, total), accepting these terms, then confirming with the “Confirm my order — payment” button, whose activation constitutes an obligation to pay within the meaning of Article L.221-14 of the Code de la consommation.
An acknowledgement of receipt summarising the order is sent to the Customer by email.
The data recorded by Spirumanne constitutes proof of the nature, content and date of the order.
Spirumanne reserves the right to refuse any order that appears abnormal, manifestly fraudulent, or comes from a Customer with whom a dispute is ongoing.
Article 6 — Payment methods
Payment is made online, over an encrypted connection, by:
- card (Visa, Mastercard) via the PayPlug or Stripe providers, with strong 3-D Secure authentication in accordance with Directive (EU) 2015/2366 (PSD2);
- PayPal;
- payment in instalments, which may be offered under the conditions displayed before confirmation. [[TO CONFIRM: minimum and maximum amounts]]
PayPlug, Stripe and PayPal are payment service providers: the Customer’s card data is processed by them and is never stored on Spirumanne’s site.
Payment by cheque made payable to Spirumanne SARL and by bank transfer remains possible (to reconfirm); the details are provided on request.
Spirumanne reserves the right to ask for a banker’s draft, proof of identity or proof of address where the sums involved are substantial.
The order is processed only after the payment has been actually received. If the banking payment centres refuse the payment, the order is automatically cancelled.
Article 7 — Delivery and lead times
Delivery is made to the address or pick-up point indicated by the Customer when ordering, by La Poste or by a carrier. It can take place only once the order has been confirmed and payment received in full.
- Dispatch time — parcels are generally dispatched between 48 hours and 7 days after receipt of payment.
- Indicative transit time — around 72 hours for mainland France with Colissimo (to reconfirm). The Mondial Relay time is shown before the order is confirmed.
- Delivery methods — Colissimo tracked (delivered without a signature; delivery against signature is possible at an additional cost, on prior request), Mondial Relay pick-up point, or collection by appointment at the Belcaire registered office.
- Maximum delivery time — thirty (30) days from the order, in accordance with Article L.216-1 of the Code de la consommation (to validate)
A tracking link is sent to the Customer as soon as possible.
Shipping costs cover packaging, handling and postage; they may include a fixed part and a variable part depending on the price or weight of the order. Two separate orders cannot be grouped: postage is due for each of them. The Customer is invited to group their purchases into a single order.
Parcels are oversized and protected; particular care is taken with parcels containing fragile products. Goods travel at the recipient’s risk.
If the announced delivery time is exceeded, the Customer may, under the conditions of Article L.216-6 of the Code de la consommation, require Spirumanne to deliver within a reasonable period and then, failing that, terminate the contract and obtain a refund of the sums paid.
Strikes, accidents, fire, failure of transport equipment and shortage of raw materials are considered cases of force majeure and release the parties from their obligations for their duration.
Any parcel not claimed and returned to the sender may be sent again at the recipient’s expense.
Article 8 — Claims on receipt
It is for the Customer to carry out all checks and make all reservations on arrival of the goods, and to exercise any recourse against the carrier where applicable.
In the event of damage or a missing product, the Customer sets out, where possible, their detailed reservations on the delivery note and reports any anomaly to Spirumanne without delay, by telephone, letter or email. This step does not limit their legal guarantees.
If there is a mistake in the order, the Customer informs Spirumanne as soon as possible. They are then offered an exchange of the non-conforming product, dispatch of the missing product if it is in stock, a credit note to use on their next order, or a refund of the missing product.
Article 9 — Invoicing
A detailed invoice is made available to the Customer and may be sent to them by email or post at the address they provide.
Article 10 — Right of withdrawal
In accordance with Article L.221-18 of the Code de la consommation (French Consumer Code), the consumer Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to give reasons or bear any cost other than that of returning the goods.
How to do it. The Customer notifies their decision by an unambiguous written statement, giving their surname and first name, email, address, and the number and date of their order:
- by email to info@spirumanne.com;
- by post to Spirumanne SARL, 57 avenue d’Ax-les-Thermes, 11340 Belcaire.
The Customer may use the standard form annexed to these terms, without being obliged to. They are invited to contact Spirumanne before returning the goods in order to obtain the return arrangements and shipping address.
Refund. Spirumanne will refund all sums paid, including the standard delivery costs initially paid, no later than fourteen days after recovering the goods or proof of their dispatch, by the same payment method used for the order. Return costs remain at the Customer’s expense.
Incomplete, worn, damaged or soiled products are not accepted.
Legal exceptions to the right of withdrawal
The right of withdrawal cannot be exercised only in the cases provided for by Article L.221-28 of the Code de la consommation, namely, for the products in our catalogue:
- goods liable to deteriorate or expire rapidly (L.221-28, 4°);
- goods unsealed after delivery which cannot be returned for reasons of hygiene or health protection (L.221-28, 5°).
These exceptions apply only where their legal conditions are met. Packaging that is still sealed and intact may be returned within the withdrawal period. They do not reduce in any way the legal guarantees mentioned in Article 11.
Article 11 — Legal guarantees
Independently of any commercial guarantee, Spirumanne remains bound by the following legal guarantees:
- Legal guarantee of conformity — the consumer Customer has the legal guarantee of conformity provided for by Articles L.217-3 et seq. of the Code de la consommation, under the conditions in force.
- Guarantee against hidden defects — Articles 1641 et seq. of the Code civil (French Civil Code), within two years from discovery of the defect.
A non-conforming, damaged or unfit product is replaced or refunded, whether it has been opened or not. The Customer is invited to write to us at info@spirumanne.com, if possible with photographs of the product and its packaging.
Article 12 — Retention of title and liability
Spirumanne retains ownership of the goods until the price has been paid in full; ownership transfers at the time of that full payment. For consumers, risk transfers when the goods are physically taken possession of.
The Customer’s failure to perform their payment obligations entitles Spirumanne to demand immediate return of the goods delivered, at the Customer’s cost and risk.
The following provisions apply to trade Customers only: in the event of insolvency proceedings or liquidation affecting the Customer’s business, the Customer undertakes to take an active part in drawing up an inventory of the goods of which Spirumanne claims ownership; failing that, Spirumanne may have the inventory drawn up by a court bailiff (commissaire de justice) at the Customer’s expense. The Customer undertakes not to resell or process the goods delivered and unpaid from the date of the judgment opening the proceedings. To secure payments not yet made, the rights relating to goods delivered but unpaid are transferred to identical goods from Spirumanne held in the Customer’s stock, without any need to allocate payments to a particular sale or delivery.
Article 13 — Personal data
The personal data provided by the Customer is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Law no. 78-17 of 6 January 1978 as amended. It is necessary for processing the order, delivery, invoicing and customer service.
It is transmitted to third parties only to the extent necessary for performance of the contract: payment providers, carriers, the host and the invoicing tool. It is not assigned to anyone for commercial purposes.
The Customer has a right of access, rectification, erasure, restriction, objection and portability, which they may exercise at info@spirumanne.com. The full details, retention periods and list of recipients are set out in our privacy policy.
To meet tax and accounting obligations, a copy of each invoice is kept for ten years from the close of the financial year (Article L.123-22 of the Code de commerce, the French Commercial Code).
Article 14 — Complaints, mediation and disputes
In the event of a difficulty, the Customer is invited to contact Spirumanne’s customer service first (info@spirumanne.com, +33 (0)6 13 12 29 18) in order to seek an amicable solution.
In accordance with Articles L.612-1 et seq. of the Code de la consommation, the consumer Customer may use a consumer mediator free of charge, after a prior written approach has remained unresolved:
- Mediator — ANM Consommation (Association Nationale des Médiateurs), 25 allée Rose Dieng Kuntz, 75019 Paris (membership to reconfirm)
- Contact details and how to refer a dispute — anm-conso.com; online referral or by post to the address above, after a prior written complaint
Article 15 — Governing law and jurisdiction
These terms of sale are governed by French law.
Failing amicable agreement, the dispute is brought before the competent French courts. The consumer Customer may, at their choice, refer the matter to the court of the place where they were living when the contract was concluded or that of the place where the harmful event occurred, in accordance with Article R.631-3 of the Code de la consommation.
Any dispute with a consumer falls within the jurisdiction of the courts designated by the applicable legal rules.
For professional Customers, any dispute falls within the exclusive jurisdiction of the Commercial Court of Carcassonne, where Spirumanne is registered (to validate).
